Why It Was So Easy
Residential construction in Minnesota, like most states, relies heavily on trust and upfront payment. There is rarely any independent party verifying that the money is being used for the project it was paid for.
Minnesota does regulate residential contractors through the Department of Labor and Industry (DLI), which licenses building contractors and maintains a Contractor Recovery Fund to compensate defrauded homeowners. But state law places limits on how much a contractor can demand upfront. Under Minnesota Statutes section 326B.809, a contractor generally may not require a homeowner to pay more than 10 percent of the contract price, or $1,000, whichever is less, as a down payment unless materials are delivered. What Escrow Would Have Changed

In an escrow model, deposit and progress payments are held by a neutral third party rather than transferred immediately to the contractor. If the contractor disappears after collecting a deposit, the money is still in escrow and can be returned to the homeowner rather than spent on someone else's job or personal bills.
Escrow also makes commingling impossible. Because each project's funds are segregated and tied to documented progress, a contractor cannot use new customers' deposits to paper over old obligations. That destroys the shell-game dynamic that allows this kind of fraud to grow undetected. By the time it collapses, far less money is at risk.
Finally, milestone-based release creates an audit trail. Every disbursement corresponds to verified work, so a stalled project is flagged early—when only a small first payment has changed hands—rather than after the entire contract value has been handed over.
