How the Fraud Was Able to Happen

Home improvement fraud thrives because the transaction is built on trust rather than verification. When a homeowner signs a contract and writes a deposit check, that money is handed over before any work is done. There is rarely a neutral third party confirming that materials were ordered, permits were pulled, or labor was scheduled.

Massachusetts law does provide consumer protections. Under the state's Home Improvement Contractor (HIC) law, Chapter 142A, contractors performing residential work must be registered with the Office of Consumer Affairs and Business Regulation. The law also limits upfront deposits to no more than one-third of the total contract price, or the cost of special-order materials, whichever is greater. In practice, however, these rules are routinely ignored, and homeowners often do not know they exist.

The larceny statute under which contractors are typically charged in these cases, M.G.L. Chapter 266, Section 30, treats theft of property valued over $1,200 as a felony.
