The Scale of the Damage

Hurricane Ian struck Southwest Florida on September 28, 2022 as a Category 4 storm. With winds reaching 150 mph at landfall near Fort Myers, it caused catastrophic damage across Lee, Charlotte, and Sarasota counties. Total damage estimates exceeded $110 billion. Nearly every structure in some communities sustained damage; tens of thousands of roofs were partially or fully destroyed.

When a storm of this scale hits, insurance companies receive hundreds of thousands of claims simultaneously. Processing slows. Homeowners, many displaced and under financial pressure, are eager to get repairs started. It is, predictably, an ideal environment for fraud.

The Assignment of Benefits Loophole

Florida had a specific mechanism that made post-Ian fraud exceptionally damaging: Assignment of Benefits (AOB) agreements. Under AOB, a homeowner could sign over their insurance claim rights to a contractor, allowing the contractor to negotiate directly with the insurer. This was intended to simplify the claims process. In practice, it created a pathway for contractors to collect large insurance payouts while doing minimal or no work — and leaving homeowners with nothing.

Florida's Chief Financial Officer, Jimmy Patronis, identified AOB abuse as a major threat following Ian. His office received thousands of complaints from homeowners who had signed over their benefits to contractors who either did substandard work, disappeared, or submitted inflated invoices the insurer refused to pay — leaving the homeowner in dispute with neither a repaired roof nor a path to resolution.

The Scam Pattern

Florida's Division of Consumer Services and the Department of Financial Services documented the common pattern across hundreds of post-Ian cases:

  1. A roofing contractor — often unlicensed or operating under a temporary license — arrives at a damaged property shortly after the storm
  2. They offer to "handle the insurance claim" and present an AOB for the homeowner to sign
  3. With the assignment in hand, they file an inflated claim with the insurer
  4. They either pocket the claim amount with minimal work, or begin work and abandon it when the insurer disputes the invoice
  5. The homeowner is left with a damaged roof, a disputed claim, and a contractor who is often now out of state

In documented cases investigated by Florida's Contractor Licensing Board, individual contractors were found to have signed AOB agreements with dozens of homeowners in a single county — collecting partial insurance payments totaling hundreds of thousands of dollars before being identified.

The Insurance Angle

AOB fraud was already so pervasive in Florida prior to Ian that the state legislature passed significant AOB reform legislation (SB 2D) in May 2022 — months before Ian hit — restricting the practice for property insurance claims. However, the reform had limited immediate impact on Ian-related fraud because many contractors had established AOB pipelines before the changes took effect, and enforcement was stretched thin by the sheer volume of post-storm activity.

Florida's Office of Insurance Regulation estimated that fraudulent and inflated claims following Ian contributed to the collapse of multiple smaller Florida homeowners insurers in 2022–2023, compounding the damage to a market that was already under severe stress.

What Would Have Helped

The AOB mechanism was specifically designed to remove the homeowner from the transaction — which is precisely what made it exploitable. Escrow works in the opposite direction: it keeps the homeowner involved at every stage of fund release, without requiring them to manage the complexity of insurance negotiations.

Had post-Ian repairs been processed through escrow:

  • Insurance funds would have been held in a neutral account, not accessible until work milestones were verified
  • Contractors would have needed to demonstrate actual progress to access funds
  • Abandoned projects would have left funds available for a replacement contractor
  • The AOB incentive structure — collect money now, deal with disputes later — would not have existed
